Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crush hazard:
a)  On or about 4/29/11 and at times prior thereto the employer does not
ensure
that employee(s) operating a powered industrial truck use seatbelts,
exposing
employees to the hazard of falling out of and being struck by a Caterpillar
Backhoe Model: 416 C, S/N 4ZN22812.
IN THE ALTERNATIVE:
29 CFR 1926.28(a): Appropriate personal protective equipment was not worn
by
employee(s)
in all operations where there was exposure to hazardous conditions:
a)  On or about 4/29/11 and at times prior thereto the employer does not
ensure
that employee(s) operating a powered industrial truck use seatbelts,
exposing
employees to the hazard of falling out of and being struck by a Caterpillar
Backhoe Model: 416 C, S/N4ZN22812.
ABATEMENT METHOD TO CORRECT THIS HAZARD ARE TO READ
AND FOLLOW THE MANUFACTURER'S INSTRUCTIONS INCLUDING
SAFETY RULES AND PRACTICES AND INSTALL A SEATBELT
EXTENSION SO THAT THE OPERATOR CAN USE THE SEATBELT
COMFORTABLY.
