Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazard from a manually propelled elevating aerial
platform:
a)  Employees were exposed to fall hazards of approximately 15 feet while
operating and
working from the Bil-Jax Manually Propelled Aerial Work Platform, Model
Number XLB-4319,
without wearing personal fall protection.
Among other methods, one feasible and acceptable method to correct this
hazard includes but
not limited to the following:
In accordance with ANSI/SIA A92.3-2006 - American National Standard
Institute for Manually
Propelled Elevating Aerial Platforms; Section 7.10 (8) "The user shall
direct the operator to
ensure all personnel on the platform wear personal protective equipment as
required." The
manufacturer's operation and maintenance manual requires " Wear protective
equipment as
required by federal, state, or local regulations.  The operator MUST wear
a safety harness and
lanyard."
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
