Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to potential fall hazards:
(a) At 3300 Bayshore Bend SE in Mandan, North Dakota, where employees were
working from a platform suspended by an all terrain forklift where the
load exceeded two
times the load center distance of the forks.
Note: Among other methods, one feasible and acceptable means of abatement
would be for the
employer to follow the established requirements set forth in ANSI B56.6
