Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:05/05/10 Condition:An employee, working near a Daewoo 300 LCV excavator, was not protected from being struck by the rotating superstructure. Among other methods, one feasible and acceptable abatement method to correct this hazard is to barricade the excavator's superstructure swing radius by caution tape or movable barriers, as recognized by the National Safety Council's Accident Prevention Manual for Business and Industry and by the Construction Industry Manufacturers Association's Safety Manual for Users, Operators, and Maintenance Personnel for Hydraulic Excavators. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
