North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)facility, dust collectors designated by the employer as dust collector number 2,3,5 and 6 - the enclosureless dust collectors were located within 20 feet of an area routinely occupied by employees. b)facility, dust collectors rated greater than 5,000 CFM designated by the employer as dust collector number 1 and 4 - the enclosureless dust collectors were located inside the building. A feasible and acceptable method to abate this hazard is to follow the guidance in National Fire Protection Association (NFPA) document 664, "Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities," 2007 edition, chapter 8.2.2.5.1.4.
