Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about June 16, 2010, and at times prior thereto, at the jobsite
located at 2903 West
Kings Highway in Paragould, Arkansas where employees were installing dry
wall on the
exterior of a new building. Employees were working from a platform mounted
to a Genie
GTH 644 rough terrain forklift that was not approved by the manufacturer
for lifting
personnel. This practice exposed the employees to the hazard of tipping
the fork lift over
and falling approximately 8 feet to the ground below. Among other methods,
feasible and
acceptable means of abatement to correct this hazard are to: (1) Comply
with the owners
manual supplied with the forklift which states on page 2-7: "Never
transport
or lift
personnel into position with this forklift. It is not designed as a
personnel lifting device."
