Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck by hazards associated with misuse of
hoisting equipment:
a) Employees were exposed to the hazard of being struck by materials being
raised and
lowered using a Chicago Electric Hoist with its lift hook wrapped around a
wooden job-made
brick holder and hooked onto the lifting cable itself.
Among others, one feasible and acceptable means of abatement would be to
comply with the
manufacturers' instructions for the use of the hoist.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the certification of corrective action worksheet).
