Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which were free
from recognized
hazards that were causing or likely to cause death or serious physical
harm
to employees in that
employees were exposed to:
a) The forklift operator was not wearing the seat belt that was provided
with the powered
industrial truck as per manufacturer instructions. A feasible method to
prevent this hazard
from occurring again is to prevent employees from operating powered
industrial trucks
without wearing seat belts.
