Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that an employee
was exposed to injury or death if the forklift he was operating overturned
and/or was involved
in am accident:
a)Coast Guard Island,on dock adjacent to the USCG CUTTER WAESCHE: A worker
was
observed operating a CAT  5000lb forklift and was not wearing the
installed seatbelt.
One feasible and acceptable method to correct this hazard is to
effectively enforce the use of
seatbelts while operating forklift trucks and train the operators as
referenced in ASME B56.1-
2000 "SAFETY STANDARDS FOR LOW LIFT AND HIGH LIFT TRUCKS.
