North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to sever lacerations: a)jobsite, the employer did not ensure that employees using a chain saw during ground operations were protected by protective leg chaps. NOTE ANSI Z133.1, Tree Care Operations- Pruning, Trimming, Repairing, and Removing Trees, and Cutting Brush- Safety Requirements, Section 4.2.7: Chain saw-resistant leg protection shall be worn while operating a chain saw during ground operations.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential falls: a)jobsite, arborist was exposed to potential fall hazards due to arborist's saddle's work-positioning lanyard was cut in two pieces that were knotted together for use and the lanyard was not removed from service. NOTE ANSI Z133.1, Tree Care Operations- Pruning, Trimming, Repairing, and Removing Tree, and Cutting Brush- Safety Requirements, Section 8.7.11: Arborists shall inspect all components of their climbing system for damage, cuts, abrasions and/or deterioration before each use. Excessively worn or damaged components shall be removed from service.
