Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
a.  Located at the Lion Habitat at the MGM Grand Hotel and Casino,
employees in
direct contact with lions were not provided specific safety procedures to
prevent
attacks/injuries.
b.  In the event of an attack or injury, the employer did not have
emergency
procedures or protocols in place.
ABATEMENT: A reasonable means of abatement would be to:
1)  Develop and implement specific written safety procedures to prevent
attacks/injuries as described in the 2011 Edition of the Association of
Zoos &
Aquariums, the Accreditation Standards and Related Policies under Dangerous
Animals 11.5.3.
The written safety procedures would then be provided to the controlling
employer.
2)  Develop and implement written emergency procedures in the event of an
attack/injury and provide to employees and any affected entities as
described in
the 2011 Edition of the Association of Zoos & Aquariums, the Accreditation
Standards and Related Policies under Emergency Procedures 11.2.3.
The written emergency procedures would then be provided to the controlling
employer.
3)  Equip the Lion Habitat with an appropriate alarm system, and/or have
protocols
and procedures in place which will notify staff in the event of a bite
injury or
attack. These systems and/or protocols and procedures must be routinely
checked
to insure proper functionality, and periodic drills must be conducted to
insure that
appropriate staff members are notified as described in the 2011 Edition of
the
Association of Zoos & Aquariums, the Accreditation Standards and Related
Policies under Dangerous Animals 11.5.2.
The protocols would then be provided to the controlling employer.
4)  Provide all employees training on safety procedures to prevent
attacks/injuries and
emergency procedures before they start their assigned duties and at least
annually
for existing employees. All employees whose safety is affected by a change
in
procedure or the environment in which they work must be trained. Any
employee
who is observed to handle lions in an unsafe manner must be re-trained. Any
employee(s) that are involved in an incident or near-miss incident shall be
retrained, and any employees who are demonstrating they have not retained
the
information for which they have been trained shall be retrained.
5)  Develop and implement a written risk management policy as described in
the
2011 Edition of the Association of Zoos & Aquariums, the Accreditation
Standards and Related Policies under Risk Management 11.4.1.
The written risk management policy would then be provided to the
controlling
employer.
6) All training records for employees shall be retained for at least 3
years and shall
include the name of the employee, the name of the trainer, the date of the
training, and the content of the training.
