Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of informing the host employer when performing work task on the Automated People Mover (APM) of the companies energy control procedures to prevent the hazard of being electrocuted, struck-by and caught-in by the rail, train and other components of the Automated People Mover (APM) system which are causing or likely to cause death or maintenance and other work tasks on the APM guide-way. Disclaimers: 1.You are not limited to the abatement methods suggested above. 2.The methods explained are general and may not be effective in all cases. 3.The employer is responsible for selecting and carrying out an appropriate method of abatement. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that Johnson Controls is informed of PBS&J's energy control procedures when performing service, maintenance and other work tasks on the APM guide-way. IN THE ALTERNATIVE: 29 CFR 1910.147(f)(2)(i): When outside personnel were engaged in activities covered by the scope and application of the standard, the onsite employer and the outside employer did not inform each other of their respective lockout or tagout procedures: The employer does not ensure that outside personnel are informed of lockout or tagout procedures when outside personnel perform service and/or maintenance tasks on equipment and machinery. This violation occurred on or about October 26, 2010 and times prior to, at the Automated People Mover (APM) system, where Johnson Controls was not informed of PBS&J lockout or tagout procedures when performing service and maintenance tasks on the APM guide-way. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure when outside servicing personnel are to be engaged in activities covered by the scope and application of this standard, the on-site employer and the outside employer shall inform each other of their respective lockout or tagout procedures.
