Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to possible amputation, being caught in and/or crushing
hazards while operating
equipment:
a.Parking Lot: On or about November 18, 2011, an employee
received a crushing injury to their leg while riding on top of a
Ditch Witch 410SX Walk-Beside Vibratory Plow, Serial #
2Y0410.  Employees were riding on top of the plow, that did not
have a seat and was designed to operate controls from the side,
while moving it to various jobsite locations.
Among other methods, a feasible means of abatement would be to:
1. train employees to operate the equipment in accordance with
manufacturers requirements; and
2. enforce with a disciplinary program.
