Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when being raised on a wooden pallet by a material lift to access the window. This hazard is identified under the American Society of Mechanical Engineers' Safety Standard for Low Lift and High Lift Trucks (ASME B 56.1, section 4.17.1 and 4.17.2). a) At the time of the inspection, an employee was being raised on a wheeled cart to make repairs to broken window panes. The following problems were found; 1. No fall protection used when lifted to a height of 10 feet. 2. The cart was not secured to the forks of the material lift. b) One method of abatement to correct this apparent hazard is to work from a ladder that is tall enough to reach the window. 1. The employer is not limited to the abatement method(s) suggested by OSHA. 2. The employer is responsible for selecting and implementing an effective abatement method. Abatement certification and abatement documentation is required for this violation. The documents should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
