Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about March 9, 2011 and times prior thereto, at Walmart Store 336
located at
1308 South Rock Street in Sheridan, Arkansas, employees were performing
warehouse
receiving tasks such as but not limited to setting dock levelers into
position between truck
bed and warehouse floor for unloading merchandise.  The right dock leveler
located next
to the south wall, also referred to as Dock number 2, in the receiving
area was damaged
and would not lock properly into place, exposing employees to the hazard
of bring struck
by steel dock plate.
