Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
On January 6, 2011, at this establishment, employees were using the top
cap of
step-ladder to access the roof top of a commercial building.  The
employees were
exposed to a fall hazard approximately 6 feet of more to the floor below.
Among other methods, one feasible and acceptable method to correct this
hazard
is to develop a policy on proper ladders usage to include, but not limited
to,
prohibiting the user from stepping, sitting, or standing on a
step-ladder's top cap
as recommended by American National Standard Institute standard A
14.5-2000,
section 9.3.2(4).
