Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crushed by hazard:
(a)Warehouse & Truck Lot:  The employer did not require and assure the use
of
a seatbelt while an employee operated a forklift to move boxes in the
warehouse and in the truck lot which exposed the employee to a crushing
hazard if he was thrown from the forklift during a turnover as determined
on
April 3, 2012.  Among other methods, one feasible and acceptable abatement
method to correct this hazard is to follow the manufacturer's operator's
manual
and abide by the safety rules and practices which require the use of a
restraint
system when operating the forklift.
