Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that two employees were exposed to struck by hazards when
working in and
adjacent to a roadway without wearing high-visibility warning garments.
(a)Highway 603 and Central Avenue - On or about November 17, 2011 two
employees were exposed to struck by hazards when working on and adjacent
to a
roadway without wearing high-visibility apparel. Two employees were
exposed to being
struck by vehicular traffic at a busy intersection where neither of the
employees were
wearing high-visibility apparel. The site did not have warning signs
posted notifying the
public employees were working ahead.
Among other methods, one feasible and acceptable method to abate hazard is
require employees
wear high-visibility apparel.
