Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a possible entrapment of the head and torso between the
forklift and the ground
or other surface while operating the forklift should a tip-over of the
forklift occur.  One feasible
and acceptable abatement method to correct this hazard is to require the
operator of the fork
truck to wear the seat belt installed on the truck by the truck
manufacturer.
A LOAD OF CONCRETE BLOCKS WAS BEING UNLOADED AND DELIVERED TO THE
RENOVATION PROJECT OF THE HOOSAC VALLEY HIGH SCHOOL IN CHESIRE, MA.
THE CRAYLER CR 50 PALREACH FORK TRUCK TIPPED FORWARD AND THREW
THE FORK TRUCK OPERATOR OVER THE CONTROL PANEL INTO THE SPACE
BEHIND THE TRUCKS MAST. THE OPERATOR WAS NOT WEARING THE SEAT BELT
PROVIDED WHICH WOULD HAVE PREVENTED HIM FROM BEING THROWN FROM
THE SEAT OF THE TRUCK.
