North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to fall and struck-by hazards:
a)jobsite, on April 20, 2011, employees worked from a work
platform (painted red) elevated by a Sky Trak Lull Model
Number 6036.  The platform was too wide to be safely used
by the 8 foot wide Lull, exposing employees to fall
and/or struck-by hazards.
b)jobsite, on April 20, 2011, employees worked from a work
platform (painted yellow) elevated by a Sky Trak Lull
Model Number 8042.  The platform was too wide to be
safely used by the 8 foot wide Lull, exposing employees
to fall and/or struck-by hazards.
c)jobsite, on April 25, 2011, employees worked from a work
platform (painted yellow) elevated by a Sky Trak Lull
Model Number 8042.  The platform was too wide to be
safely used by the 8 foot wide Lull, exposing employees
to fall and/or struck-by hazards.
d)jobsite, on April 29, 2011, employees worked from a work
platform (painted red) elevated by a Sky Trak Lull Model
Number 8042.  The platform did not indicate: (1) maximum
work load including personnel and equipment; (2) weight
of empty platform.
Among other methods, one feasible and acceptable means to correct
these hazards are:  Ensure employer consults with the Manufacturer,
Lull operator's safety manual and specific load chart designated
for the specific piece of equipment and attachments to determine
proper load capacities, and the ANSI B56.6, which states:  To be
approved the fork-mounted personnel work platforms must comply with
the following design requirements before the platform is used:
1.The platform floor must be slip resistant and not located more
than 8 inches (200 mm) above the normal load-supporting
surface of the fork.
2.The platform floor dimensions shall not exceed: a. Two times
the load center distance as identified on the load chart for
the attachment being used. b. The platform shall not be wider
than the width of the telehandler (excluding outriggers) plus
10 inches (250 mm) on each side. c. Minimum space for each
platform occupant shall not be less than 18 inches (450 mm) in
either direction.
3.A 4 inch (100 mm) minimum high toe plate must surround the
perimeter platform but may be omitted at the access opening.
4.Work platform occupants must be protected from pinch points or
moving parts.
5.The following information must be on the personnel workplatform: a.
Maximum work load including personnel and
equipment. b. Weight of the empty platform.
6.Provide a means to securely mount and attach the platform to:
a. Only be centered side to side on the attachment and
retained against the vertical face of the forks or carriage.
b. Prevent the platform from inadvertent pivoting.
7.The platform must be equipped with a guardrail meeting the
following criteria: a. A nominal height to the platform of 42
inches (1066 mm) around the perimeter of the platform and
include a midrail. b. The guardrail shall be capable of
withstanding a concentrated horizontal force of 200 lb (890 N)
applied at the point of least resistance without permanent
deformation.
8.The platform must be equipped with at least one lanyard
anchorage point for each occupant and the anchorage point must
be capable of withstanding consecutive drop tests to simulate
a 250 lb (113 kg) person falling 6 feet (1800 mm) without
allowing the test weight to fall free to the ground. A
deceleration device may be included.
9.All load supporting structural elements of the work platform
shall have a structural safety factor of not less than 2 to 1
based on the minimum yield strength of materials used.  The
use of any work platform is prohibited if it does not meet all
of the above stated design requirements.
