employer did not furnish employment and a place of employment which were

from recognized hazards that were causing or likely to cause death or
serious
physical harm to employees in that employees were exposed to the hazard of
getting caught-in a wood chipper:
a) for employees operating the Brush Bandit Brush Chipper (Model 1890,
serial number
001083) at 3917 W. Euclid Avenue in Tampa (FL) on or about 06/14/2011.  On
this
date, employees were operating the equipment but had not received training
in the proper
use of the equipment.
Abatement Note(s): Feasible and acceptable abatement methods include
following
the safety guidelines outlined in ANSI Z133.1-2006:
Section 3.1.2: The employer shall instruct their employees in the
proper use, inspection and maintenance of tools and equipment,
including ropes and lines, and shall require appropriate work
practices be followed.
Section 8.6.5: Training shall be provided in the proper operation,
feeding, starting, and shutdown procedures for the chipper being
used.
Section 8.6.9: Foreign material, such as stones, nails, sweepings,
and rakings shall not be fed into chippers.
Dwayne Wilson Tree Service was previously cited for a violation of this
occupational safety
and health standard or its equivalent standard [Section 5(a)(1), General
Duty Clause], which
was contained in OSHA inspection number 315037572, citation number 1, item
number 1 and
was affirmed as a final order on 03/10/2011 to a workplace located at
12911 Golf Crest Trail
in Tampa, FL 33618.

1)The emergency shut-off device (Last Chance Stop) was missing
2)The foldable feed tray extension was missing
3)The hinges on the drum cover plate were rusted and broken
exposing employees to the chipper drum assembly
4)The electrical interlock of the drum cover had been bypassed
and made inoperable
Abatement Note(s): Feasible and acceptable abatement methods include
maintaining
all
safeguards in operational condition as outlined in the safety guidelines
in ANSI Z133.1-
2006, Section 5.3.
Dwayne Wilson Tree Service was previously cited for a violation of this
occupational safety
and health standard or its equivalent standard [Section 5(a)(1), General
Duty Clause], which
was contained in OSHA inspection number 315037572, citation number 2, item
number 1 and
