Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that ; employees were
exposed to struck-by, caught in between and falls from elevated heights,
when the employer
failed to ensure a Genie Aerial lift, Model number Z-40, Serial number
Z4ON11-955, was
operated in accordance with the operator's manual, which states "do not
raise or extend the
boom unless the machine is on FIRM, level surface". This violation was
observed on or about
December 3, 2011, in the new auditorium of the Santa Fe High School, where
employees were
instructed to work from the basket of an extended boom on a Genie Arial
lift while it was on
an unlevel/uneven surface. As a result, the Arial lift over turned and an
employee was pinned
in the basket against the wall and the other was pinned between the basket
and the brick wall.
ABATEMENT NOTE:
Among other procedures, one feasible and acceptable abatement method to
correct the hazard
is for the employer to ensure management and the operators are aware and
understand the
requirements in the operator's manual.
