Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
did not wear the seat belt while operating the Yale fork truck exposing
them to the hazard of
being thrown outside the forklift cage causing serious injury:
Warehouse - The seat belt provided on the Yale fork lift truck was not
worn by operators
and its use was not enforced by management.
One method of abatement, among others, is to establish a policy requiring
the use of the
seat belt and enforce the policy.
