Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
On 2/9/12, employees were exposed to approximately a 7 feet fall hazard,
while working
inside a mushroom growing house. The temporary opening in the  walkways and
stairwell openings, had no rails to protect the workers from falling
through the gaps on
floor.  At the time of the inspection the temporary opening was being used
to load boxes
of produce.
A feasible means of abatement among other methods, the employer could
place a guard
that would prevent the employees to fall, and if necessary will allow to
use the opening
to lower the boxes to a lower level.
NOTE: ABATEMENT CERTIFICATION AND DOCUMENTATION IS
REQUIRED WITHIN 10 DAYS AFTER ABATEMENT DATE. THE
CERTIFICATION SHALL INCLUDE A STATEMENT THAT ABATEMENT IS
COMPLETE, THE DATE AND METHOD OF ABATEMENT, AND STATE THAT
EMPLOYEES AND THEIR REPRESENTATIVES WERE INFORMED OF THIS
ABATEMENT. ABATEMENT DOCUMENTATION SHALL INCLUDE
DOCUMENTS DEMONSTRATING THAT ABATEMENT IS COMPLETE, SUCH
AS EVIDENCE OF THE PURCHASE OR REPAIR OF EQUIPMENT,
PHOTOGRAPHIC, OR VIDEO EVIDENCE OF ABATEMENT OR OTHER
EVIDENCE OF ABATEMENT OR OTHER WRITTEN RECORDS.
