Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing injuries in the event the rough terrain forklift
tipped over when driving
with the forks extended and elevated:
(a)Construction Site, Apartment West Wing - The employer did not ensure
that
employees did not move rough terrain forklifts with the load raised, as
evident
by the fact that on or about November 11, 2011 an employee was moving a
Pettibone 10056 rough terrain forklift towards a building with the arm and
load
raised approximately 25 to 30 feet above grade, and the lift became
unstable and
tipped over.
Feasible and acceptable methods of abatement to correct this hazard
include the following:
Keeping the forks low while moving around the work area and being careful
while raising the
load (Ref. Pettibone 6K, 8K, 10K Forklift Operation and Maintenance
Manual). Travel with
load-engaging means or load low, where possible, and tilted back. Do not
elevate the load except
during stacking (Ref. ANSI B56.6-2011 Paragraph 6.3.12).
Abatement certification and documentation required within 10 days after
abatement date. The
certification shall include a statement that abatement is complete, the
date and method of
abatement, and state that employees and their representatives were
informed of this abatement.
Abatement documentation shall include documents demonstrating that
abatement is complete,
such as evidence of the purchase or repair of equipment, photographic or
video evidence of
abatement or other written records.
