Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that, employees
were exposed to the hazard of being infected with Mycobacterium
tuberculosis through
unprotected contact with patients who were infectious or were suspected to
be infectious with
tuberculosis (TB). There was no system in place to promptly identify, mask
and isolate patients
with suspected tuberculosis who came to the clinic for treatment. In
addition employees who
have face-to-face contact with patients with suspected or confirmed TB
disease were not
provided information and training on tuberculosis.
