Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employmnent and a place of employment which are free from recognized struck-by and/or crushed-by hazards which are causing or likely to cause death or serious physical harm to employees: This violation occurred on April 18, 2012, at a workplace located at 5200 Harry Hines Blvd., Dallas, Texas; where the employer, by not ensuring that safe clearances were maintained between the forklift truck and employees, and employees would not step into the path of travel of the lift truck, exposed employees to struck-by and/or crushed by hazards. Among other methods, a feasible and acceptable means to abate the hazards includes but is not limited to: 1.Safeguard pedestrians at all times, and exercise particular care during backing and other operations where pedestrians may step into the path of travel of the truck as per section 6.2.6 of ANSI/ITSDF B56.6-2005, Safety Standard for Rough Terrain Forklift Trucks. 2.Keep a clear view of the path of travel and observe for other traffic, personnel, and safe clearances as per section 6.3.8 of ANSI/ITSDF B56.6-2005, Safety Standard for Rough Terrain Forklift Trucks. 3.Use of a dedicated traffic control monitor (signalman) whose job is to direct forklift operators and help ensure safe clearances are maintained and that employees do not step in the forklift trucks' path of travel. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the requirement, including describing the steps it is taking to protect workers from being struck-by and/or crushed-by powered industrial trucks and similar pieces of equipment.
