HAR 12-60-2(a)(3) was violated because:
The employer failed to regularly inspect rack systems for damage and
replace or repair
damaged racks.  Employees were working in a warehouse where the shelving
units were
damaged and bent from incidental contact with forklifts, thus being
exposed to struck by and
crushed by hazards.  ANSI MH16.1:2008 Specification for the Design,
Testing, and
Utilization of Industrial Steel Storage Racks, Section 1.4.1(2) states
"The owner shall
maintain the structural integrity of the installed rack system by assuring
proper operation,
housekeeping, and maintenance procedures including, but not limited to the
following:  (1)
Prohibit any overloading of any pallet positions and of the overall rack
system.  (2)
Regularly inspect for damage.  If damage is found, immediately unload the
affected area and
replace or repair any damaged columns, beams or other structural
components."
12-60-2(a)(3) states "Every employer shall provide safe work places and
practices by
elimination or reduction of existing or potential hazards.  Elimination of
existing or potential
hazards by design, process substitution, or other appropriate methods is
preferred because it
eliminates the need for further employee protection.  When elimination is
not feasible,
reduction of existing or potential hazards to acceptable levels, using
methods such as
engineering or administrative controls, isolation, or guarding, shall be
promptly used.  When
these methods are inadequate to reach acceptable levels, personal
protective equipment shall
be provided and used."
