North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his/her employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee were exposed to struck by. a)at the mechanic shop: the employer did not maintain or implement periodic inspection for a Joyce hydraulic automotive lift, model and serial #s unknown, capacity 8,000 pounds, available for employees use on their day-to-day operation. Reference:Automotive Lift Institute (ALI) Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION AND MAINTENANCE. ALI/: "instructs that car lifts undergo annual inspections administrated by qualified lift inspectors..." One feasible and acceptable method of abatement is for the employer to have the lift inspected by a manufacture representative who can insure if the modification meets manufacturer's specifications. b)at the mechanic shop: the employer allowed employees to use 6-inch tire rims or a piece of lumber, approximately 4 feet long and 7 inches high, in place of jack stands while performing car repairs and/or maintenance on their day-to-day operation. Reference:The American Society of Mechanical Engineers (ASME)- SAFETY STANDARD FOR PORTABLE AUTOMOTIVE LIFTING DEVICES (PALDS). ASME/: General Requirements - Product Marking and Identification: 1.1 Rated Capacity: "All PALDS shall have the rated capacity in a prominent location on the PALD by casting imprint, metal stamp or use of durable material and attachment methods." One feasible and acceptable method of abatement is for the employer to purchase jack stand with proper rated capacity to be used on the mechanic shop setting.
