Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:
(a)Date of Violation:11/13/13
Location:West Side of Site
Condition:Where employees were working on the third floor of the parking
garage area, while
ready-mix concrete, a corrosive material having a pH of 12 to 13, was
being poured
via a concrete pump truck, the nearest portable eyewash station was
located on the first
level of the parking garage area, a distance of approximately 74 feet.
Among other methods, one feasible and acceptable method to correct this
hazard is to install self contained
portable eyewash stations on the same work level, and within 10 seconds
walking distance of where
mechanical pumping/mixing of concrete is occurring, in accordance with
American
National Standards
Institute ANSI Z358.1-2009, Section 5.4.2.
Abatement documentation (photographs, receipts, copies of programs,
training certification, etc.)
is required for this item.
