29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Jobsite: On or about March 30, 2011 and times prior thereto, the competent person on site did not take appropriate actions to protect employees who performed water pipe installation activities outside of the protective trench shield. These activities included but were not limited to, checking grade, installing seals and locks on the pipe, and cutting the pipe. b) Jobsite: On or about March 30, 2011 and times prior thereto, the competent person on site allowed employees to work in an estimated seven foot deep trench with near vertical walls, installing an air vac vault structure without a protective system in place. Note) Abatement certification is not required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) Jobsite: On or about March 30, 2011 and times prior thereto, employees working in an estimated six foot deep trench, performed water pipe installation activities outside of the protective trench shield. b) Jobsite: On or about March 30, 2011 and times prior thereto, employees working in an estimated seven foot deep, vertical walled trench, installed an air vac vault structure without a cave-in protection system in place. 29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard did not ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment was not completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly: a) JObsite: On or about March 30, and times prior thereto, the employer had not conducted an exposure assessment for workers cutting and removing up to 850 linear feet of water pipe with a coating found to contain asbestos. After it had been brought to the employers attention that the pipe may contain asbestos, and samples were sent for analysis, the employer continued to cut and remove the pipe until positive sample results were known. Note) Abatement certification is not required for this item.
