29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Kalamunda Construction, LLC @ 34999 Hwy 6 # 926, Edwards, CO 81632: On and before June 3rd, 2011 the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of approximately feet and 29 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. (a)Kalamunda Construction, LLC @ 34999 Hwy 6 # 926, Edwards, CO 81632: On and before June 3rd, 2011, exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system, in that, employees were engaged in framing and sheathing operations on the roof of the Vail Mountain Rescue project without the use of a fall protection system. This condition exposed the employee to a fall hazard of approximately 29 feet.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one handrail and one stairrail system along each unprotected side or edge: (a)Kalamunda Construction, LLC @ 34999 Hwy 6 # 926, Edwards, CO 81632:On or before June 3rd, 2011, the exposing employer did not ensure that the interior stairway inside the building under construction being used by employees to gain access to the second level, rising approximately 14 feet, was equipped with an adequate stairrail system, in that the top stairrail and midrail was not appropriately installed along with no intermediate vertical members. Employees utilizing the stairs to reach the second level of the home were exposed to fall hazards of approximately 14'.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist the employees in mounting and dismounting the ladder (a)Kalamunda Construction, LLC @ 34999 Hwy 6 # 926, Edwards, CO 81632: On or before June 3rd, 2011, the exposing employer did not ensure that employees were utilizing portable ladders in such a way that enabled them to access and egress from work areas using ladders that extended 3' above the walking working surface. Employees were using a portable step-ladder for access to the roof. Employees were exposed to a fall of approximately 14' while attempting to use the ladder.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: (a)Kalamunda Construction, LLC @ 34999 Hwy 6 # 926, Edwards, CO 81632: On or before June 3rd, 2011, the exposing employer allowed employees to utilize an A-frame ladder to be used for access where employees were using the top step to climb off of to reach the roof. The condition of standing on the top step is prohibited by the manufacturer instructions for use. The condition caused the ladder to become unstable and exposed employees to a fall hazard of approximately 14 feet. Kalamunda Construction, LLC was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(4) which was contained in OSHA Inspection Number 313412884, Citation Number 1, Item 2 issued on October 8th, 2009, and became Final Order on November 26, 2009, with respect to a workplace located at 600 Columbine Road, Breckenridge, CO 80498.
