Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment or a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards:    a)  On or about June 3, 2011, an employee was exposed to fall hazards of over 10 feet while he stood on and worked from a broken and damaged wooden pallet which was elevated by a rough-terrain forklift.  The employee was not provided with fall protection and the pallet was not secured to the forklift to prevent if from sliding off the forks.          Abatement:    Among other methods, one feasible and acceptable abatement method to correct the hazard is to provide the training required by ASME 56.6 (paragraph 5.17) which would ensure that operators are knowledgeable of safety rules such as the paragraph 5.15 which states that a rough terrain forklift shall not be used to lift people unless there is no other practical option and the precautions listed in sub paragraphs (a)-(y) are taken.  These precautions include, but are not limited to, securely attaching the lift carriage to the forks and ensuring that the platform complies with the design requirements listed in Part III of the Standard.

29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)  29 CFR 1926.451(g)(1):  On or about June 3, 2011, the employer did not ensure that  employees were protected from fall hazards of up to 15 feet while they worked on an elevated platform (wooden pallet on a forklift) without adequate guardrails or another fall protection system.
