29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:\r\n\r\n a) Jobsite: On July 22, 2011 and times prior thereto employees engaged in framing activities were exposed to an approximate 18 foot fall hazard to the ground below while setting trusses from the exterior top plate of the structure with out a fall protection system in place. b) Jobsite, second floor level: On July 22, 2011 and times prior thereto, employees were exposed to a fall hazard at the unprotected edge around the stairway where a guardrail system was not in place. Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: a) Jobsite: On July 22, 2011 and times prior thereto employees and the responsible person on site, did not acknowledge the fall hazards when performing framing activities which included setting trusses from the exterior top plate, and take the appropriate actions to eliminate or minimize the hazards. b) Jobsite: On July 22, 2011 and times prior thereto employees and the responsible person on site, did not acknowledge the fall hazard of the unprotected side or edge around the stairway, and take the appropriate action to eliminate or minimize the hazard. Note) Abatement certification IS required for this item. Note) Effective September 16, 2011 conventional methods for fall protection, per 29 CFR 1926.501(b)(13) shall be used. The alternative methods for fall protection in residential construction as described in STD 03-00-001 will no longer be acceptable.
