29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.\r\n\r\n\r\nUpsomer Construction on or about August 9, 2011 at the address of 2501 Northtowne Rd. Findlay, OH 45840: The employer did not assure that employees operating the nail gun during roofing work wore eye protection to protect against flying object hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Upsomer Construction, on or about August 9, 2011 at the address of 2501 Northtowne Rd. Findlay, OH 45840: The employer did not ensure employees were protected from falls while installing new roofing material on a residential type structure. Employees were exposed to up to 15 falls to the asphalt below.
