29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) Alvarez Varela, Carlos dba Emilios Construction at 3358 North Valentia Street, Denver, CO 80230: On or before August 20, 2011, the employer did not ensure that employees wore safety glasses when using or working in the vicinity of pneumatic nail guns. Condition exposed employees to the hazard of projectiles to the eyes. Abatement note: Abatement certification is required for this item (see enclosed, "Sample Abatement-Certification Letter").

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) Alvarez Varela, Carlos dba Emilios Construction at 3358 North Valentia Street, Denver, CO 80230: On or before August 20, 2011, the employer did not ensure that the path to ground was permanent and continuous in that a Craftsman Skilsaw was missing its ground plug. The saw was not double insulated, but were operated on a ground fault circuit interrupter (GFCI). Condition exposed employees to electrical shock hazards. Abatement certification is required for this item (see enclosed, "Sample Abatement-Certification Letter").
