29 CFR 1926.102(a)(1):     Employees shall be provided with eye and face protection equipment when machines or operationspresent potential eye or face injury from physical, chemical, or radiation agents.    a.   On the roof where employees were using pneumatic nail guns to nail down shingles, the employer did not provide or enforce the use of eye protection thereby exposing employees to a contact haard.

29 CFR 1926.1053(b)(6):     Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement.    a.    On the roof of the Verizon Building where employees were accessing a higher roof from a lower roof, the base of the ladder was not placed on a level surface nor was the top of the ladder tied or secured to prevent displacement thereby exposing employees to a fall hazard.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.   On the roof of the Verizon Store where shingles were installed, fall protection such as, but not limited to, harnesses and lifelines thereby exposing employees to a 15 to 20 foot fall hazard.    The Sustaita's Construction Company was previously cited for a violation of this occupational safety and health standard or it's equivilant standard, 1926.501(b)(1) which was vcontained in OSHA inspection 314342817, Citation Number 1, Item 1 and was affirmed as a final rule on July 28, 2011 with respect to a workplace located at 10301 Contiga Way, Miamisburg, Ohio 45342.
