Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from an elevated scissor lift platform:    (a)	23rd Street and Frontage, Lewiston: On 08/05/11 and at times prior thereto, five workers were not wearing high visibility reflective vests while forming concrete curbs.     Among other methods, one feasible and accepted method to correct this hazard is to ensure workers are trained and comply with safety rules prescribed in the Manual for Uniform Traffic Control Devices (current version 2009), including Section 6D.03, Worker Safety Considerations, which states in part, All workers, including emergency responders, within the right-of-way who are exposed either to traffic (vehicles using the highway for purposes of travel) or to work vehicles and construction equipment within the TTC zone shall wear high-visibility safety apparel that meets the Performance Class 2 or 3 requirements . . .     Note:  Abatement certification IS NOT required for this item.
