OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    On or about August 25, 2011 an employee was working in a confined space, opening a hole in a manhole vault, to perform a stormwater run off drainage connection. The employee was working without any confined space training, monitoring or entry programs or procedures in place exposing the employee to asphyxiation, toxic atmospheres or entrapment.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)

29 CFR 1926.21(b)(6)(i):     Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and the use of protective and emergency equipment required.    On or about August 25, 2011 an employee was working in a confined space (manhole vault) without being instructed in the hazards, having the necessary precaution or required equipment exposing the employee to the hazards of working in a confined space.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.    On or about August 25, 2011 employees were working in a trench cutting a manhole vault for a storm water run off connection without a competent person evaluating the trench, exposing the employees to the hazards associated with trench collapse.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)
