29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Old World Chimney Sweep, LLC on or about August 31, 2011, at the address of 215 W. Wayne St., in Lima, OH: The employer did not assure an employee was protected from head injuries while working below an employee performing chimney repair work.  The employee was exposed to potential impact injuries caused by falling material and/or tools.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) Old World Chimney Sweep, LLC on or about August 31, 2011, at the address of 215 W. Wayne St., in Lima, OH: Personal fall arrest systems or guardrail systems was not in place to protect an employee from an approximate 22-foot fall hazard while working on a tubular welded scaffold system.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Old World Chimney Sweep, LLC on or about August 31, 2011, at the address of 215 W. Wayne St., in Lima, OH: An employee working on a scaffold was not trained by a qualified person to recognize and control fall hazards, and falling object hazards. An employee was exposed to an approximate 22-foot fall hazard while working on a tubular welded scaffold system and an employee below was exposed to being struck by falling objects.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
