29 CFR 1926.20(b)(2):     The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a) There was no frequent and regular inspection program maintained in use by a competent person to ensure demolition job site materials and equipment such as floor and partition wall removal retaining support process systems, demolition engineering survey and fall protection systems or devices were being maintained and utilized in a safe condition.

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On or about August 31, 2011 and prior to that time located along perimeter exterior areas of the structure employees performed construction / demolition operations without conventional fall protection on balcony decks adjacent to unprotected sides or edges and were exposed to fall potentials in excess of 8'.

29 CFR 1926.850(a):     Evidence in writing was not available that an engineering survey performed by a competent person had been performed prior to permitting employee(s) to start demolition operations:  a) On or about August 31,2011 and prior to that time located throughout the exterior motel demolition operation employees were involved in hand demolition of floor and partition support and non support wall tempory retaining support processes without a written engineering survey to detect the posibility of unplaned collapse of floors or walls and procedures or methods for temporary support and removal during those operations.
