29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) Powers and Sons, LLC - Montpelier, OH: On or about September 1, 2011, the employer did not assure that energy control procedures were utilized to control hazardous energy when employees performed change-over activities on the W-7 Broach machine. Employees were exposed to pinch points and crushing injuries in that energy control was not utilized before servicing the machine. b) Powers and Sons, LLC - Montpelier, OH: On or about September 2, 2011, the employer did not assure that energy control procedures were utilized to control hazardous energy when employees performed change-over activities on the HT-18 Broach machine. Employees were exposed to pinch points and crushing injuries in that energy control was not utilized before servicing the machine. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a) Powers and Sons, LLC - Montpelier, OH: On or about September 1, 2011, employee(s) were exposed to pinch point and crushing injury risk in that the W-7 Broach machine was not locked out prior to performing change-over activities on the machine. Prior to accessing the hazard areas of the machine the employer did not assure energy control application steps were implemented as required by paragraph (d) of this section the employer did not: Ensure employees had the method or means to control hazardous energy; physically operate energy isolating devices to control energy sources and affix lockout device(s); ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe, and; verify that isolation and deenergiziation of the machine or equipment had been accomplished. b) Powers and Sons, LLC - Montpelier, OH: On or about September 2, 2011, employee(s) were exposed to pinch point and crushing injury risk in that the HT-18 Broach machine was not locked out prior to performing change-over activities on the machine. Operators that service the machines were not trained to lock out the machine to protect against pinch point hazards. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Powers and Sons, LLC - Montpelier, OH: On or about September 6, 2011, the employer did not assure that employees were protected from rotating parts of the Spinner machine located in the Z-leg assembly area in that the barrier guard was not effective. The guarding device did not prevent employees from reaching past the guard to the hazard area while the machine could operate. b) Powers and Sons, LLC - Montpelier, OH: On or about September 6, 2011, the employer did not assure that employees were protected from rotating parts of the torque tester machine located in the Tie-Rod assembly area in that the barrier guard was not effective. The guarding device did not prevent employees from reaching past the guard to the hazard area while the machine could operate. c) Powers and Sons, LLC - Montpelier, OH: On or about September 6, 2011, the employer did not assure that employees were protected from rotating parts of the Spinner machine located in the Tie-Rod assembly area in that the barrier guard was not effective. The guarding device did not prevent employees from reaching past the guard to the hazard area while the machine could operate. d) Powers and Sons, LLC - Montpelier, OH: On or about September 6, 2011, the employer did not assure that employees operating the W-7 Broach machine were protected from pinch point hazards created as the rods are lowered through the parts being manufactured, and into the lower bed of the machine. e) Powers and Sons, LLC - Montpelier, OH: On or about September 6, 2011, the employer did not assure that the HT-18 Broach machine was guarded protect operators from pinch point hazards. The points where the rods are lowered through the parts and into the lower portion of the machine, and again when the rods are raised by the lower ram through the parts created pinch points. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
