29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Jobsite:  On August 8, 2011 and times prior thereto, employees performing framing activities on the second floor were exposed to an approximate ten and half foot fall hazard to the ground floor below where a floor hole was not guarded by a cover or guardrail system.      b) Jobsite: On August 8, 2011 and times prior thereto, employees performing framing activities on the second floor were exposed an approximate 13 and a half foot fall hazard to the outside from unguarded window openings.      c) Jobsite: At times prior to August 8, 2011 employees perfomed framing activities on an approximate 10 in 12 pitched roof and 4 in 12 pitched roof without a fall protection system in place.     Note) Abatement certification is NOT required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems,warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) Jobsite: On August 8, 2011 and times prior thereto the responsible person on site along with the employees performing framing activities did not recognize potential fall hazards in areas including but not limited to, a floor hole and unguarded window opening(s), and take minimum actions to correct or minimize the hazards.     b) Jobsite: On August 8, 2011 and times prior thereto the responsible person on site was not familiar and did not require the use of alternative fall protection methods or conventional fall protection systems when employees performed framing activities including, but not limited to, sheathing and setting trusses.         Note) Abatement certification IS required for this item.
