29 CFR 1910.132(d)(1):     The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).           At the work site located at 2805 Columbus-Lancaster Road, Lancaster, Ohio, employees cleaned an indoor firing range for approximately two hours per day, approximately four days per week. The employer's job hazard assessment did not address the hazards of lead that employees were exposed to when cleaning the indoor firing range.

29 CFR 1910.132(f)(1):     The employer shall provide training to each employee who is required by this section to use personal protective equipment (PPE). Each such employee shall be trained to know at least the following:  When PPE is necessary; what PPE is necessary; how to properly don, doff, adjust and wear PPE; limitations of the PPE; and the proper care, maintenance, useful life and disposal of the PPE.              At the work site, the employer did not adequately train all employees in the use of personal protective equipment (PPE). All employees who cleaned an indoor firing range had access to PPE that included (but was not limited to) tyvec suits with attached boot covers and hoods, eye protection, hearing protection, gloves and respiratory protection.

29 CFR 1910.134(c)(1):     In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the provisions of this section, as applicable.        At the contracted work site, employees cleaned an indoor firing range where lead was known to be present for approximately two hours daily, approximately four to five days per week.  They were required by the employer to wear dust masks while working on the firing range.  The employer did not have a respiratory protection program.

29 CFR 1910.1200(g)(1):     The employer shall maintain in the workplace copies of the required material safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s).(Electronic access, microfiche, and other alternatives to maintaining paper copies of the material safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)            The employer did not have a material safety data sheet on lead for employees who cleaned at a firing range where lead was present. The employees cleaned a firing range for approximately two hours per day, approximately five days per week.

29 CFR 1910.1025(d)(1)(iii):     Full shift personal samples shall be representative of the monitored employee's regular, daily exposure to lead.      2805 Columbus-Lancaster Road, Lancaster, Ohio  On or about JUne 2005, the employer did not ensure representative full-shift personal sampling for lead was performed to evaluate employee lead exposures during the indoor firing ranges (contracted work site) busy season, fall and winter.  The employers one-time sampling for lead at the indoor firing range was performed during the summer of 2005, which represents the sites slower season.
