29 CFR 1910.1025(e)(4)(i):     When ventilation is used to control exposure, measurements which demonstrate the effectiveness ofthe system in controlling exposure, such as capture velocity, duct velocity, or static pressure shall be made at least every 3 months. Measurements ofthe system's effectiveness in controlling exposure shall be made within 5 days of any change in production, process, or control which might result ina change in employee exposure to lead.            At the work site located at 2805 Columbus-Lancaster Road, Lancaster, Ohio 43130, the employer had a ventilation system in the indoor shooting range.  The employer did not ensure the ventilation system performance checks were done and documented quarterly.

29 CFR 1910.1025(h)(1):     Surfaces. All surfaces shall be maintained as free as practicable of accumulations of lead.                At the work site, the employer did not maintain surfaces as free as practicable from the accumulation of lead during the operation of a business that involved an indoor firing range.  These surfaces included (but were not limited to) window sills in all three bays of the indoor firing range, the floor in the janitor's closet at the exit from bay #3, the floor at the exit from the range at bay #1, the floors behind the sales counter by the door leading from the office area, the sales floors behind the sales counter near the entrance to the indoorn firing range, sink handles in the public men's restroom, on the top step to the upstairs area, on the refrigerator and freezer handles in the upstairs employee break room, on the tile floor just inside the archery demonstration area, and at the check out area by the door leading through the customer exit door.
