CFR 1926.20(b) (2):  The employer did not provide programs for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer.    	(a)	Chimney Jack, 3494 W. Hayward Place, Denver, CO 80211:  On and before October 6, 2011, as the exposing and controlling employer for two employees working on a steep pitch roof, Chimney Jack failed to provide for regular inspections of the job site by a designated competent person. Condition exposed employees to fall hazards of over 12 feet due to a lack of adequate fall protection.    Abatement Note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification worksheet").

CFR 1926.501(b) (13):  Each employee engaged in residential construction activities 6 feet  (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems;    	(a)	Chimney Jack, 3494 W. Hayward Place, Denver, CO 80211:  On and before October 6, 2011, two employees of the controlling and exposing employer working on 12:12 pitch roof were not protected from falling by a system as described above.  Specifically, two employees were leaning near the edge of the roof to perform tuck pointing and masonry work on a chimney.  Condition exposed employees to fall hazards of approximately 12 feet.    Abatement Note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Worksheet").

Hayward Place, Denver, CO 80211:  On and before October 6, 2011, the controlling and exposing employer did not ensure that a portable extension ladder used to gain access to the upper landing where work was taking place extended at least 3 feet above the landing surface. Condition exposed employees to fall hazards of approximately 12 feet as they accessed the landing using the ladder.
