29 CFR 1926.95(a):     Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:    Jerry Gray, conducting work at 139 Ferris State Ct., Elyria, OH: On or about October 12, 2011, the employer failed to ensure that employees were wearing appropriate eye protection such as, but not limited to, safety glasses while securing shingles to the roof with a pneumatic nail gun. Employees were exposed to the hazards of eye injury from flying objects.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    Jerry Gray, conducting work at 139 Ferris State Ct., Elyria, OH: On or about October 12, 2011, the employer did not ensure that employees were protected from head injury hazards by protective hard hats while working below employees who were replacing a 12/12 pitch roof of a two story residential building. Employees were exposed to potential impact injuries caused by falling materials and/or equipment.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    Jerry Gray, conducting work at 139 Ferris State Ct., Elyria, OH: On or about October 12, 2011, the employer did not ensure that employees were protected from fall hazards while replacing a 12/12 pitch roof of a two story residential building. Employees were exposed to fall hazards of approximately 12 to 30 feet from the roof to the ground below.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Jerry Gray, conducting work at 139 Ferris State Ct., Elyria, OH: On or about October 12, 2011, the employer failed to ensure that employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while replacing a 12/12 pitch roof of a two story residential building. Employees did not use fall protection and were exposed to fall hazards of approximately 12 to 30 feet from the roof to the ground below.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    Jerry Gray, conducting work at 139 Ferris State Ct., Elyria, OH: On or about October 12, 2011, the employer did not ensure that an extension ladder, used to access the roof of the two story residential building, was extended at least 3 feet above the roof edge. The employees were exposed to approximately a 10 foot fall hazards when using the ladder to access the working level in order to conduct roofing activities.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
