29 CFR 1926.651(b)(1): The estimated location of underground utility installations, such as sewer, telephone, fuel, electric, water lines, or any other underground installations that reasonably may be expected to be encountered during excavation work, were not located. (a) Prior to excavation work to install sewer lines for grease traps of the Indian Head Casino project, the location of a newly installed 20KV feeder line had not been determined. The excavation operator contacted the energized line, which subsequently arc and tripped the pole breaker.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury. (a) Operator(s) of excavation equipment were not aware of regulations to prevent accidental contact with buried energized conductors prior to opening excavations. This resulted in contact being made with a 20KV energized conductor by the excavator operator who was unaware its location. Surveying and marking of newly installed energized feeder lines would be one method to prevent contact with them. Note: Abatement certification and supporting documentation are required for this item.
