Section 5(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from a work platform on a rough terrain forklift that exceeded an overall width greater than 10 inches on either side of the load bearing wheels:    (a)  On or about October 5, 2011, and at times prior to that date, for the employees installing siding while working from a 15-foot forklift platform elevated by a Skytrac rough terrain forklift, with a 24-foot aluminum scaffold pick attached to the platform.  The employees were exposed to fall hazards of approximately 15 feet, located at 301 South Spring Avenue, Sioux Falls, South Dakota.

29 CFR 1926.304(h)(1):  Each circular crosscut table saw was not guarded by a hood which completely enclosed that portion of the saw blade above the table and that portion of the saw above the material being cut:    (a)  On or about October 5, 2011, and at times prior to that date, for the employees using the Dewalt table saw without a guard in place to cut siding and other trim materials, located at 301 South Spring Avenue, Sioux Falls, South Dakota.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:    (a)  On or about October 5, 2011, and at times prior to that date, for the employees installing siding while working from a 15-foot forklift platform elevated by a Skytrac rough terrain forklift, with a 24-foot aluminum scaffold pick attached to the platform.  The employees were exposed to fall hazards of approximately 15 feet, located at 301 South Spring Avenue, Sioux Falls, South Dakota.    Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 311870661, Citation 1, Item 1A, and was affirmed as a final order on May 12, 2008, with respect to a workplace located at Spring Brook Estates in Sioux Falls, South Dakota.
