29 CFR 1910.1030(c)(1)(ii)(A):  The employer's Exposure Control Plan did not include the exposure determination required by 29 CFR 1910.1030(c)(2):    a) On or about October 13, 2011, at the above located workplace, where employees were exposed blood, the employer's Exposure Control Plan did not include an exposure determination which included:    i) A list of all job classifications in which all employees in those job classifications have occupational exposure without regard to the use of personal protective equipment;    ii) A list of job classifications in which some employees have occupational exposure without regard to the use of personal protective equipment;    iii) A list of all task and procedures or groups of closely related task and procedures in which occupational exposure occurs and that are performed by employees in job classifications listed in accordance with the provisions of paragraph 29 CFR 1910 (c)(2)(i)(B).

The review and update of such plan did not:    i) Reflect changes in technology that eliminate or reduce exposure to bloodborne pathogens; and    ii) Document annually considerations and implementations of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure:    a) On or about October 13, 2011, at the above located workplace, where an employee experienced a sharps injury, the workplace bloodborne pathogen exposure control program had not been reviewed since 2005.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employee exposure:    a) On or about October 13, 2011, at the above located worksite, employees used lancets to check draw blood and determine glucose levels. The lancets did not have engineered sharps injury protection, and placed the employees at an increased risk of needle sticks injuries. Effective and appropriate sharps with engineered sharps injury protection were commercially available. Employees using the devices without engineered sharps injury protection were therefore exposed to the hazard of blood borne disease.

29 CFR 1910.1030(f)(1)(ii):  The employer did not ensure that all medical evaluations and procedures including  the Hepatitis B vaccine and vaccination series and post-exposure evaluation and follow-up, were provided as required by 1910.1030 (f)(1)(ii)(A) through 1910.1030 (f)(1)(ii)(D):    a) Between approximately May 13, 2011 and October 13, 2011, at the above located worksite the employer did not offer a totally free Hepatitis B vaccination series. The employer required employees that did not complete the three shot series to pay for shots they received.

29 CFR 1910.1030(h)(1)(ii)(B): The medical record for an employee with occupational exposure did not include a copy of the employees hepatitis B vaccination status including the dates of all hepatitis B vaccinations and any medical records relative to the employees ability to receive vaccination as required by  29 CFR 1910.1030(f)(2):    a) On or about October 20, 2011, at the above located workplace, the employer did not maintain the hepatitis B vaccine declination statement for the three (out of a total of four) nurses that that had exposure and declined the hepatitis B vaccination.    b) On or about October 20, 2011, at the above located workplace, the employer did not maintain the hepatitis B vaccine declination statement for the two (out of a total of five) support staff employees that had exposure and declined the hepatitis B vaccination
